Restaurant owners group calls out 'widespread abuse' of fake PWD cards for discounts

The Restaurant Owners of the Philippines (Resto PH) called out the "widespread abuse" of fake persons with disabilities (PWD) cards for discounts.

On Feb. 3, restaurateur and content creator Myke Sarthou, or Chef Tatung, on behalf of the group, on Facebook said fake PWD cards are crippling the restaurant industry.

"The PWD discount was created to support those who genuinely needed it, but widespread abuse of fake PWD cards is now putting a serious strain on restaurants and other businesses," Resto PH said. "Many people don't realize that it's not the government covering the 20% discount—it's the businesses themselves. Every fraudulent discount comes directly out of a restaurant's pocket, cutting into already thin margins."

The group noted that it isn't just an inconvenience for restaurants, especially small and family-run ones, but also a financial hit that can mean the difference between survival and closure.

"When multiple fake PWD cards are used at a single table, the losses can be devastating," it said. "This isn't just about lost revenue; it affects employees, food quality, and even menu prices for honest customers.

Resto PH said they're asking for fairness, and the "discount should help those it was meant for instead of being a loophole for those looking to save a few pesos at the expense of struggling businesses."

"If you care about the restaurants you love, help protect them—say no to fake PWD cards," it added.

Republic Act No. 10754, or the Act Expanding the Benefits and Privileges of Persons with Disability, states that people "who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others" are entitled to at least 20% discount and value-added tax exemption for their "exclusive use and enjoyment or availment" during sales and services. The Department of Health will classify the PWDs through an issuance.

In October 2024, the Department of Justice released a legal opinion pointing out that PWDs—and senior citizens—get the 20% discount and VAT exemption only for themselves. They can get the perks for group meals, as long as they will have the food alone during dine-in transactions.

The discount is "deemed flexible" and is "adjusted accordingly" as food establishments "estimate single food purchase for an individual."
