The Land Transportation Office will begin revoking the driver's licenses of motorists caught driving under the influence of alcohol starting Nov. 15.

In a Facebook post on Oct. 29, the LTO said it had issued Memorandum No. MVL-2026-242, directing deputized law enforcement officers to strictly follow the prescribed testing procedures under Republic Act No. 10586, or the Anti-Drunk and Drugged Driving Act of 2013.

As part of the procedure, officers must first conduct a Field Sobriety Test on drivers suspected of driving under the influence of alcohol. If a driver fails the test, an authorized breath analyzer must then be used to determine the driver's blood alcohol concentration.

The implementing rules of RA 10586 set a blood alcohol concentration threshold of 0.05% for private vehicle drivers operating vehicles with a gross vehicle weight not exceeding 4,500 kilograms. Drivers of trucks, buses, motorcycles, and public utility vehicles are subject to a zero-alcohol limit.

The LTO clarified that a breath analyzer cannot be used as the initial screening test or as the sole basis for preliminary testing.

The agency also emphasized its authority under Section 27(a) of Republic Act No. 4136, or the Land Transportation and Traffic Code, to revoke the licenses of motorists deemed to be improper persons to operate motor vehicles.

The LTO said the Law Enforcement Service must submit records of apprehensions, including cases in which drivers refuse testing, to the Intelligence and Investigation Division for review and appropriate action.

The law also prohibits driving under the influence of alcohol, dangerous drugs, or similar substances. It provides for the automatic revocation of the driver's license of motorists who refuse to undergo mandatory testing, in addition to other applicable penalties.
