DOLE to implement 'no work, no pay' rule on Aug. 23

The Department of Labor and Employment (DOLE) has issued a pay rule for the two holidays this coming weekend. 

In the advisory, the agency said that employers can apply the “no work, no pay” rule for employees who will not report for work during the observance of Ninoy Aquino Day, a special non-working holiday on Friday, Aug. 23. 

“Unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day, no work no pay principle applies,” DOLE said.

Those who will still be coming in during the holiday shall be paid an additional 30% of their basic wage for the first eight hours of work.  

Employees required to report on the special non-working holiday which also falls on their rest day shall be paid an additional 50% of their basic wage on the first eight hours of work, and another 30% for overtime work. 

For National Heroes’ Day, a regular holiday on Monday, Aug. 26, employees required to come in shall be paid double their regular daily pay. An additional 30% of their hourly rate will also apply if they render overtime. 

Those who will report on the regular holiday that falls on their rest day shall receive an additional 30% on top of the 200% pay. Likewise, an additional 30% of the hourly rate will be paid for overtime hours.  

Those who will not report on the regular holiday shall receive 100% of their regular daily pay “provided that the employee reports to work or is on leave of absence with pay on the day immediately preceding the regular holiday.”

Malacañang announced on Aug. 15 the changing of date for Ninoy Aquino Day through Proclamation No. 665 amending the previous announcement of regular and special holidays for 2024. 

According to the proclamation, the holiday was moved "to provide for a longer weekend thereby promoting domestic tourism, the celebration of Ninoy Aquino Day may be moved from 21 August 2024 (Wednesday) to 23 August 2024 (Friday), provided that the historical significance of Ninoy Aquino Day is maintained." 

Ninoy Aquino Day, observed annually on August 21, commemorates the life and legacy of former senator Benigno "Ninoy" Aquino, a critic of the late Ferdinand Marcos Sr., current President Marcos Jr.'s father. 

The National Heroes’ Day, meanwhile, is observed on the last Monday of August to honor and commemorate the unknown and notable personalities from the past or present who have contributed to the freedom and pride of the Philippines. (With reports from Mayen Jaymalin)
