Bacoor court affirms Archie Alemania's guilty verdict in acts of lasciviousness case
The Bacoor Trial Court has affirmed Archie Alemania's earlier guilty verdict in the acts of lasciviousness case filed against him by actress Rita Daniela.
In a copy of the court decision obtained by GMA News Online, the Bacoor Regional Trial Court Branch 116 in Cavite affirmed the October 2025 ruling that found Archie Alemania guilty beyond reasonable doubt of acts of lasciviousness.
The decision, dated Aug. 3, 2026, was signed by Presiding Judge Persephone Meir B. Belena.
The case arose from a complaint filed by Daniela against Alemania concerning an alleged incident that occurred on or about Sept. 9, 2024, in Bacoor City, where she recalled the actor making a vulgar statement toward her when they attended a Thanksgiving party.
After the party, Alemania allegedly offered Daniela a ride home, which she accepted because she thought he was just being like an older brother. However, during the ride, Daniela recalled Alemania beginning to caress her shoulder and neck, which she found "uncomfortable."
She also alleged that Alemania started forcibly kissing her and groped her.
Later on, Alemania supposedly texted Daniela to apologize, saying that he was drunk.
In December 2024, Alemania submitted a counter-affidavit on the complaint. He also pleaded not guilty to the charge in April 2025.
In rejecting Alemania’s challenge to the physical circumstances of the incident, the court ruled that the acts described by the complainant—restraining, kissing, and groping inside a vehicle—were not inherently impossible, noting that they “may be uncomfortable or difficult, but not contrary to human experience," per GMA News Online.
The court cited Daniela’s consistent account, Alemania’s admissions, his apology message, and the circumstances surrounding the incident as sufficient evidence to establish his guilt beyond reasonable doubt.
Daniela’s legal counsel, Atty. Maggie Abraham-Garduque, confirmed to PhilSTAR L!fe in October 2025 that Alemania was found guilty. He was sentenced to up to one year in prison. He was also ordered to pay P20,000 in civil indemnity and another P20,000 in moral damages.
Daniela and Alemania were co-stars in the teleserye Widows' War.
