Michelle Dee files theft complaint anew against Rhian Ramos' driver

Actress Michelle Dee has once again filed a qualified theft complaint against Rhian Ramos' former driver, "​​Totoy," at the Makati Prosecutor's Office.

The move follows the dismissal of the earlier complaint by the same court on Jan. 19. The court said the complaint has to be refiled to follow the correct process, which involves inquest proceedings. 

"Naging issue lang po doon sa resolution ng Office of the City Prosecutor noong Jan. 19 inquest investigation is whether or not subject for inquest 'yung kaso," Dee's lawyer Atty. Maggie Garduque told Unang Balita.

"Kaya sinabi nila, dalhin sa regular preliminary investigation at doon natin imbestigahan, at saka nila aaksyunan ang merits ng kaso, whether or not there is a reasonable certainty of conviction to indict [Totoy] for qualified theft na finile ni Ms. Michelle Dee."

Dee filed a theft case against Totoy after he allegedly took an angpao containing ten valuable items unbeknownst to the actress-beauty queen. Garduque said nine of them were returned with the help of the driver's wife, albeit one item remains missing.

On Jan. 19, Dee and Ramos' group reportedly brought Totoy to Makati Police and eventually filed a formal charge of qualified theft against him for illegal possession of purported sensitive photographs.

The driver was detained but was released on Jan. 22 after the prosecutor's office dismissed the complaint.

On Jan. 28, Totoy filed a complaint against Dee, Ramos, Samantha Panlilio, their bodyguards, and some Makati policemen, accusing them of serious illegal detention and torture.

Dee and Ramos have denied the illegal detention accusation, with their lawyer explaining that the driver's claims are "physically impossible." 

On Feb. 2, the National Bureau of Investigation said it is validating all statements and evidence in Totoy's complaint.
